Terms of Service

NewBuilt.com ("NewBuilt," "we," "us") is a new construction model home showcase operated by NewBuilt LLC. These Terms of Service ("Terms") govern your use of newbuilt.com and related services. By using NewBuilt, you agree to these Terms.

NewBuilt.com is free for home buyers. No account is required. We do not capture or sell your personal information. We do not require registration to browse model homes.

Model home information (pricing, availability, specifications) is provided for informational purposes only. Prices, floor plans, and availability change frequently. Always verify details directly with the builder or your real estate agent before making purchasing decisions.

NewBuilt is not a real estate brokerage and does not provide real estate advice. The sponsoring agents displayed on the site are independent licensed real estate professionals. NewBuilt does not employ, endorse, or guarantee the services of any agent.

3.1 Subscription

Agent sponsors pay a monthly subscription fee to participate in the NewBuilt Sponsor Program. Subscriptions are billed monthly via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period.

3.2 Tier Pricing & Lock

Your subscription tier (Founding, Early, or Standard) and monthly rate are determined by availability at the time you subscribe and are locked for the duration of your continuous subscription. If you cancel and later resubscribe, you will be placed at the current tier and pricing based on availability at that time.

3.3 Organic Impression Rotation

Organic impressions (visitors who arrive at NewBuilt without clicking an agent's share link) are distributed equally among all active agent sponsors in that city via automated round-robin rotation. Each new organic visitor is assigned to the next agent in sequence. The visitor sees that agent consistently for the duration of their browsing session (up to 24 hours).

NewBuilt does not guarantee a specific number of organic impressions. Impression volume varies with site traffic and the number of active sponsors in your city. Equal distribution among active sponsors is guaranteed and auditable via your monthly report.

3.4 Share Links & Exclusive Attribution

Agent sponsors can generate branded share links to send to their buyers. When a buyer clicks an agent's share link, that agent is displayed exclusively to that buyer for 30 days. This attribution is cookie-based and persists across all pages the buyer visits on NewBuilt during that period.

Share link attribution does not transfer between devices or browsers. If a buyer clears their cookies or uses a different device, they may see a different agent via organic rotation.

3.5 City Caps

Each city has a maximum number of agent sponsor slots. Once all slots are filled, new agents are placed on a waitlist. When a slot opens, the next agent on the waitlist is offered the slot at current pricing.

3.6 Monthly Reports

Agent sponsors receive monthly reports showing their impression count, share link clicks, and organic vs. referred visitor breakdown. Reports are generated from anonymized impression logs — no personally identifiable buyer information is shared with agents.

3.7 Agent Conduct

Agent sponsors must hold a valid, active real estate license in the state(s) where they sponsor. Agents must not misrepresent their affiliation with NewBuilt — you are a "Sponsoring Agent on NewBuilt," not an employee or partner of NewBuilt. We reserve the right to remove any agent sponsor who violates these Terms, misrepresents their licensing, or engages in conduct that harms buyers or the NewBuilt platform.

Post-close sponsor advertisements (pools, landscaping, furniture, etc.) are displayed on a per-city basis. Sponsor placement is managed by NewBuilt and is not influenced by agent sponsors, builders, or other third parties. Sponsored content is clearly labeled.

We make every effort to keep model home information accurate and current. However, builders change pricing, floor plans, and availability frequently. NewBuilt is not responsible for inaccuracies in listing data. If you find incorrect information, please use the "Report an issue" feature on any model page.

Photos on NewBuilt are of actual model homes wherever possible. Some builder-provided renderings may be used when model homes are under construction. All photos are attributed to their source.

The NewBuilt name, logo, design, and original content are the property of NewBuilt LLC. Model home photos may be subject to builder copyright. Agent sponsor headshots and branding remain the property of the respective agents.

NewBuilt is an informational showcase. We are not a party to any real estate transaction. We do not guarantee the accuracy of listing data, the quality of any agent's services, or the outcome of any home purchase. Use of NewBuilt is at your own risk.

To the maximum extent permitted by law, NewBuilt LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

We may update these Terms from time to time. Material changes will be communicated to active agent sponsors via email. Continued use of NewBuilt after changes take effect constitutes acceptance of the updated Terms.
